Başta Hanefî mezhebi olmak üzere, “mütekavvim mal” kavramının en önemli kıstaslarından biri, müntefe‘un bih, yani “hukuken faydalanılabilir” olmadır. “Müntefe‘un bih” kavramının müstakil olarak tüm yönleriyle çalışmaya konu edilmesi, İslam hukukunun “meşru mal” tasavvurunu ortaya koyma açısından önem arz etmektedir. Konu, Hanefî ve Şâfiî mezhebi çerçevesinden ele alınmış olup, müntefe‘un bih kavramını esas kabul etmeleri açısından, Hanefî doktrin görüşleri noktasında daha çok detaya girilmiştir Araştırma büyük oranda satım akdini ilgilendirdiği için, birkaç farklı akit dışında teori, bey‘ akdi üzerinden inşa edilmeye çalışılmıştır.&#13;
Çalışmanın amacı; mütekavvim mal kavramının sınırlarını, bir malın mütekavvim kabul edilmesinde necisliğin mutlak kriter olup olmayacağını ve müntefe‘un bih kavramının bazı akitlerin sıhhatini belirlemedeki etkisini ortaya koymaktır. Araştırma, Hanefi-Şâfiî fürû literatüründe; “müntefe‘un bih”, “mütekavvim” ve “mâliyyet” gibi kavramlar üzerinden detaylı kavram taramaları neticesinde ortaya konulmuş ve yakın zamanda yapılmış çalışmalarla zenginleştirilmiştir. Araştırmanın sonucunda, “müntefe‘un bih” kavramına, meselelerin çözümünde temel bir ilke olarak genişçe yer veren mezhebin Hanefîler olduğu gözlemlenmiştir.; As a result of this study, it will clarify the issues such as goods and mutaqawwim. "Muntafa'un bih", that is, "considered legally usable", is an important issue that has been discussed in many subheadings of Islamic law and has not been the subject of research. One of the areas where the concept of muntafa'un bih is decisive is muamalat and in a narrower sense, the sales contract. In a sales contract, the primary condition for a good to be subject to a contract is that it is "muntafa'un bih". The concept of muntafa'un bih also has a relationship with methodological principles such as "foods that are haram or halal to be renewed", "mutaqawwam goods", "need," and "maslahah. In this study, the concept of "muntafa'un bih" is revealed by stating its relationship with concepts such as mutaqavvim and al-mal (goods). In addition, it has been put forward due to a comparative analysis of some controversial legal transactions due to different definitions of goods in the doctrine. Some of the interesting sales examples discussed in the study are Elephant sales, cat-dog sales, silkworm sales, bee sales, sale of predatory animals, myth sales (Animals that died in a way that is not legally deemed appropriate to eat), and fertilizer sale. In the Hanafi sect, accepting a good as legitimate for sale is approached more flexibly, unlike other sects. There are some key concepts behind this. The concept of "muntafa'un bih", is a concept derived from the Quran and Sunnah of Islamic law. They accepted this as a determining criterion in deciding the legitimacy of contracts. In this study, Hanafi imams based their differences of opinion on almost all issues in the mentioned topics with the concept of "muntafa'un bih" bih. The benefit of taking into account the usability of something when deciding to sell it as a commodity is that Muslims are kept away from useless activities. As a matter of fact, in the hadiths, our Prophet stated that one of the things that show how good faith a person has is that he stays away from useless things. He also said that the best people are those who are most helpful to people. In the Surah al-Mu'minun, those who will attain salvation are listed as those who perform their prayers in awe and avoid vain activities. This indicates how important it is to the benefit of people in Islam. With this study, it has been revealed that the main criterion for the good to be subject to sale is that it is muntafa'un bih rather than continuous. The most important result of this is that the sale of pork and wine is permissible for non-Muslims. Because their religion does not prohibit a non-Muslim from using them. Essentially, the equation is very simple. What Hanafis want to say is that Islam forbids the eating of manure, not its sale. Fertiliser is an extremely important factor in the continued production of vegetables and fruits. Likewise, animals such as dogs, whose meat is not legitimate to eat, can be used in another way. For example, shepherds and hunting dogs. This makes it inevitable for them to be subject to a sales contract. Wild and predatory animals can only be used by humans for permissible purposes such as hunting. Likewise, if it is aimed to provide human comfort, such as transportation, they can be used. In all these examples, the condition for using wild animals is that they must be trained. A wild animal that has not been taught cannot be resigned anyway. More precisely, the criterion for being helpful to wild animals is to be trained. Therefore, since feeding animals that benefit people this way is legitimate, their sale is also permissible. According to the Hanafi sect, for goods to be considered mutaqawwim, it must also have an economic value (cost). In addition, it must be permissible in Sharia to benefit from it, even if there is no necessity. At the same time, the subject is missing in recent research. It contains original information about unique concepts such as tamawwul and maliyyah, which are important parameters of the Hanafi sect's concept of property. The concept of "muntafa'un bih" is a concept developed mostly by Hanafis and used in solving problems with a more flexible perspective. Hanafis have accepted as legitimate not only the immediate benefit of the contract but also the transactions that will provide benefits in the future. However, in the Shafi sect, with which we made brief comparisons, it has been observed that the provisions are sometimes justified by being "muntafa'un bih."

In Islamic law of obligations, the declarations of intent which constitute the es-sential elements (rukn)of a contract must converge in terms of time or place for the contract to be concluded. This convergence is facilitated by what is referred to as the contract session (majlis al-'aqd).The contract session is a foundational condition for the formation (in'iqad)of a contract, with its primary function be-ing to establish a connection between the offer (ijab)and acceptance (qabul).Modern definitions typically emphasize this aspect of the contract session, often neglecting its impact on the validity (ia)of the contract. However, an exami-nation of the rules governing exchange contracts and the defect (fasad)theory articulated within the anafi school demonstrates that numerous conditions must be fulfilled within the session to ensure the validity of the contract or to rectify a defective (fasid)contract. This article, therefore, explores the influence of the contract session on the formation and validity of a contract, specifically within the scope of the anafischool.To this end, the concept of the contract session and its role within contract theory are first addressed. Subsequently, the relationship between the contract session and the formation and validity of a contract is analyzedin two stages, the first being the in'iqad session, which en-compasses the period between offer and acceptance. The session of contract formation (majlis al-in'iqad)begins with an offer and concludes with acceptance. In the session of contract formation, the time elapsed between offer and acceptance is considered as if it were a single moment. Pro-vided that no circumstance disrupts the continuity of the session during this pe-riod, the acceptance is deemed inseparable from the offer, and they are consid-ered, in effect, to have been made consecutively. In this process, sustaining the unity of the assembly requires the parties to remain actively involved with the contract and to avoid any actions that may indicate a withdrawal from it. The second stage of the session extends from the point of acceptance until the parties' physical separation. Considering the impact of this phase on the contract, it would be appropriate, in our view, to refer to it as the validity session (majlis al-ia).There are three primary reasons forthe emergence of the validity ses-sion in contracts: preventing the exchange of debt for debt, avoiding interest (riba),and eliminating defective elements to render the contract valid According to the Hanafi school,in a sale contract, the physical delivery of the sold item during the contract session is not required to prevent the exchange of debt for debt. Instead, the item shouldbe designated during the contract session. However, delivering the exchanged items during the contract session is obligato-ry in advance payment sale (salam) and currency exchange (sarf) transactions. For the validity of these contracts, the designation and delivery must occur no later than the moment the parties physically separate. In this context, this ses-sion stagemay be regarded as a session of validity. The second factor that brings outthe session of validity is the prohibition of in-terest. Suppose the exchanged items share common characteristics in terms of measurement by volume (kayl) or weight (wazn). In that case,one of the two goods being exchanged must be designated during the contract session to pre-vent the emergence of deferred interest.&#13;

Furthermore, if the tradedgoods are of the same genus, equality must be ensured during the contract session to avoid surplus interest. In both cases, the relevant period extends not only until the ac-ceptance of the contract but also until the parties physically separate after ac-ceptance. Thus, it is evident that the session of validity plays a decisive role in ensuring compliance with the conditions related to the prohibition of interest. The third factor that brings outthe validity session is removinga corrupting el-ement (mufsid)to render the contract valid. For the defect to be rectified, it must not have become fixed, and there must be no definitive decision by the parties or a judicial ruling to annul the contract. In some cases, the fixation of the defect is contingent upon the contract session. Once the parties physically separate, the defect becomes fixed, and rendering the contract valid is no longer possible.; Bu makalede İslam borçlar hukukunda akdin in’ikad şartlarından biri olan akit meclisi, Hanefî mezhebi özelinde incelenmiştir. İrade beyanlarının sahih biçimde bağ oluşturmasını sağlayan akit meclisi, güncel çalışmalardaki tanımlarda genellikle bu işleviyle ele alınmış, akdin sıhhati üzerindeki etkisi ihmal edilmiştir. Bu çalışmanın hedefi, Hanefilerin mübadele işlemleri için öne sürdüğü şartlar ve fesat teorisi bağlamında akit meclisinin akdin sıhhati üzerindeki etkisini ve bu etkiye bağlı olarak meclis sürecinde oluşan değişimi ortaya koymaktır. Bu amaçla çalışmada öncelikle akit meclisinin akit teorisindeki yerinden kısaca bahsedilmiş, ardından akdin in’ikadı ve sıhhatiyle olan ilişkisi, iki aşama halinde ele alınmıştır. Çalışmada doküman analizi yöntemi kullanılmış, Hanefî klasiklerinde farklı meselelerde dağınık halde bulunan veriler toplanarak değerlendirilmiştir. Bu değerlendirmeye göre akit meclisinin yalnızca icap ve kabul arasındaki süreçten ibaret olmadığı, akdin sıhhatini sağlayan ve mecliste yerine getirilmesi gereken belirli şartlar sebebiyle kabulden itibaren tarafların ayrılığına kadar geçen sürecin de akit meclisine dahil olduğu görülmüştür. Buna istinaden akit meclisi tanımlarında meclisin sıhhat işlevine de vurgu yapılması gerektiği sonucuna varılmıştır.

Arabuluculuk faaliyetinin sona ermesi üzerine, arabulucu tarafından bir son tutanak düzenlenir. Arabuluculuk son tutanağı, anlaşma, anlaşamama veya arabuluculuk sürecinin hangi şekilde sona erdiğini gösteren ve arabulucu tarafından düzenlenmesi zorunlu olan bir belgedir. Bunun dışında, arabuluculuk süreci sonunda taraflar uyuşmazlık konusu üzerinde anlaşmışlarsa, bir arabuluculuk anlaşma belgesi düzenleyebilirler. Anlaşma belgesi düzenlenip düzenlenmeyeceğine taraflar serbestçe karar verir. Zira Kanun’da arabuluculuk anlaşma belgesinin düzenlenmesine ilişkin bir zorunluluk bulunmamaktadır. Ancak arabuluculuk anlaşma belgesi düzenlenmemesinin bazı sakıncaları vardır. Örneğin, anlaşma belgesinin düzenlenmemesi hâlinde, tarafların anlaşmasının kapsamı ve içeriğinin açık ve kesin bir şekilde belirlenmesi mümkün olmadığı için edimler ifa edilirken problemler yaşanabilir. Ayrıca uyuşmazlığın tarafı, icra edilebilirlik şerhi alarak anlaşma belgesinin ilam niteliğinde belge olmasını sağlama ve buna dayanarak ilamlı icra takibi yapma imkânından mahrum kalır. Bununla birlikte, arabuluculuğa başvurunun amaçlarından biri, tarafların arabuluculuk süreci sonunda anlaşmalarını sağlayarak uyuşmazlıkları sona erdirmek ve mahkemenin iş yükünü azaltmaktır. Anlaşma sağlanmasına rağmen anlaşma belgesi düzenlenmemesi ise, tarafların anlaşmasının kapsamının belirlenmesi, bunun içeriğinin nasıl ispat edileceği, mahkemeye başvurulmasının mümkün olup olmadığı gibi bazı hususlar bakımından başka ihtilafların ortaya çıkmasına neden olabilecek niteliktedir. Bu bağlamda, arabuluculuk süreci sonunda anlaşma sağlanması hâlinde, anlaşma belgesinin düzenlenmesinin zorunlu kılınması, söz konusu ihtilafların önüne geçilmesini sağlayabilir.

Her birey gibi engelli bireyler de temel hak ve özgürlüklere sahip olup bu hak ve özgürlükler uluslararası sözleşmeler, Anayasa ve çeşitli kanunlar ile koruma altına alınmıştır. Temel hak ve özgürlüklerden biri engelli bireyin yaşamını sürdürebilmesini ve toplumsal hayata katılımını sağlayan çalışma hakkıdır. Sosyal devlet ilkesi gereği devlet, engelli bireylerin çalışma hakkını ayrımcılığa maruz kalmaksızın etkin şekilde kullanımını sağlamaya ilişkin tüm önlemleri almakla yükümlüdür. Bu kapsamda engellilerin istihdamına yönelik birçok istihdam yöntemi geliştirilmiştir. Engellilerin istihdam edilme yöntemlerinden biri de ülkemizde ilk olarak 2005 yılında 5378 Sayılı Engelliler Hakkında Kanun ile yürürlüğe giren korumalı işyeri uygulamasıdır. Korumalı işyeri uygulaması ile iş gücü piyasasına kazandırılmaları güç olan zihinsel veya ruhsal engellilerin normal işgücü piyasasında bulunan rekabet ortamı ve başarısız olma kaygısı olmaksızın, Devlet tarafından teknik ve mali yönden desteklenen ve çalışma ortamı özel olarak düzenlenen işyerlerinde istihdam edilmesi amaçlanmaktadır.
