İslam Yargılama Hukukunda hâkim

Abstract

İslam Yargılama Hukukunda Hâkim? adlı bu çalışma `Giriş' ve `Sonuç' dışında üç bölümden oluşmaktadır.Giriş kısmında; tezin konusu, amacı, önemi ve sorumluluğu ile araştırmada ele alınan yöntem hakkında bilgi verilmiştir.Birinci bölümde; Fıkıh literatüründe hâkim ve hâkimde bulunması gereken şartlar konusu ele alınmış, bu bağlamda hâkim kelimesinin tanımı ve hâkimde bulunması gereken şartlar hakkında bilgi verilmiştir.İkinci bölümde ise; hâkimlik mesleğinin usul ve esasları konusu incelenmiştir. Bu bölümde öncelikle hâkimlik mesleğinin usul ve esasları konusu işlenerek, bu bağlamda hâkimlerin bu görevi yürütürken genel olarak takınmaları gereken durumlar hakkında bilgi verilmiştir. Örneğin günümüzde de oldukça dikkat çeken hâkimin hediye kabul etmesi, davetlere katılması, yargılama esnasında taraflara eşit davranması gibi konular bu bölümde işlenmiştir. İkinci olarak da yargılamanın usul ve esasları konusu işlenerek bu kapsamda gerek yargı yeri, gerek mahkemede hâkimin yardımcıları, gerekse hâkimin yargılama esnasındaki ruhi durumu gibi konular hakkında bilgi verilmiştir.Üçüncü bölümde ise; yargılama usulü açısından hâkim konusu işlenerek bu açıdan hâkimlik mesleğinin içeriği hakkında bilgi verilmiştir. Bu kapsamda hâkimlerin tayinleri, azilleri, görevleri ve kendisine gelen davalar hakkında yapmakla yükümlü olduğu görevler konusu işlenmiştir. Bunların yanında hâkimin, hüküm bildirirken dayanakları ve taraflara karşı görevleri konusu hakkında da bilgi verilmiştir.Anahtar Sözcükler: İslam hukuku, Usûl-i Fıkh, Fetva, Hâkim, Yargı, Hüküm, İçtihat. This work under the title of ?The Judge in The İslamic Jurisdiction? consists of three sections apart from ?Introduction? and ?Conclusion.?In the introduction section, information about the subject, aim, importance and responsibility of the thesis together with the method used thoughout the research.In the first section, discussing the issue of judge in Law Literature and conditions a judge must possess, information in this context about the definition of the word ?judge? and the conditions which a judge must possess.In the second section, the issue of the manner and essentials of judgeship is examined. In this section, dealing with the manner and essentials of judgeship primarily, information about the attitudes they should have generally while performing this service in this context is given. For instance, issues which also attract great attention today such as judge?s admission of presents, attending invitations, behaving equally to the parts while judging are discussed in this section. Secondly, dealing with the manner and essentials of judgement, information about the issues like the judgement place, assistants of the judge in the court, judge?s psychological condition while judging is given.In the third section, treating the issue of judge in terms of judgement manner information about the contents of judgeship in this context is given. Within this scope, the issue of judges? appointments, dismissals, missions and tasks they have to fulfill for cases coming to them.
