Türk hukukunda sakin şehir kriterlerini destekleyen mali düzenlemeler

Abstract

Devletler sahip olduğu yükümlülükler gereği kamusal bazen de özel ihtiyaçları karşılar nitelikte mal ve hizmetlerin üretimi için farklı mali araçları kullanmakta ve bu sayede ekonomik ve sosyal gelişmeye katkı sağlamaktadır. Sakin şehir hareketininse; ekonomik, sosyal ve çevresel anlamda sürdürülebilir sistemlere ait dinamiklerin oluşturulması, korunması, geliştirilmesi ve sürdürülmesinde alternatif bir kalkınma modeli olduğu kabul edilmektedir. Hareket; temel amaçlarına ulaşmada tüzüğünde kabul ettiği kriterleri aracı olarak belirlemiştir. Türkiye’de bir dizi hukuki düzenlemeyse, hali hazırda sakin şehir kriterlerinin gerçekleştirilmesinde (teşvik ve vergi bağışıklığı gibi) kolaylıklar sağlamaktadır. Bu çalışma ile sakin şehir hareketine ait kriterlerden hangilerinin devletçe, mali ya da yine yüklediği mali ödevlerin karşılığı olarak sunduğu kamu hizmetleriyle, ne şekilde desteklendiğinin belirlenmesi amaçlanmıştır. Kanun hükümlerinin lafzi yöntemle yorumlanması ve sistematik literatür taraması yöntemlerinin kullanıldığı çalışmada; üç ana kritere ait sekiz alt kriterin devletçe desteklendiği ve ağa dâhil olmuş yahut aday yerleşim yerlerinin dosyalarında bu destekleri belirtmeleri gerektiği sonucuna varılmıştır.

As a result of the proprietary liability, states make use of varied financial intermediaries in order for the production of goods and services that meet public or private needs, and by this means, contribute to economic and social development. Slow city movement is acknowledged as an alternative development model in establishing, conserving, improving and sustaining the dynamics of the sustainable systems in economic, social and environmental sense. The movement has identified its criteria, which are accepted in its legislation, as intermediary in order to achieve its fundamental objectives. In Turkey, a range of legal arrangements provide convenience for the realization of the current slow city criteria (such as incentive and tax exemption). In this regard, the current study aims to identify which of the criteria of slow city movement are supported by the state financially or through public services in acknowledgement of the financial liability, and how this support is realized. The study, which employed the grammatical interpretation of the provisions of law and systematic literature review, identified that a total of eight sub-criteria of three main criteria were supported by the state. Regarding this, candidate sites need to specify the support they receive on their files.
