Şâtıbî'nin usûl anlayışında manevî istikrâ

Abstract

Bu çalışmada, Şâtıbî'nin benimsemiş olduğu manevî istikrâ yönteminin, tarihî arka planı gözetilerek ve usûl anlayışıyla bağlantısı kurularak bütünlük içerisinde ortaya konulması amaçlanmıştır. Giriş ve sonuç kısımları dışında dört bölümden oluşan bu çalışma kapsamında; manevî istikrânın fikrî temelleri ve fıkıh tarihindeki bazı tezahürleri, Şâtıbî'yi bu yöntemi benimsemeye sevk eden temel sebepler, manevî istikrânın mahiyeti, ilgili olduğu temel kavramlar ve manevî istikrâ yöntemiyle ispat ve temellendirilmesi yapılan küllî asıl/ilke ve maksatlar incelenmiştir. el-Muvâfakât'ın esas alındığı bu çalışmada içerik analizi ve mukayese yöntemleri izlenmiştir. Çalışma neticesinde, manevî istikrânın köken itibariyle manevî tevatür, istikrâ ve karîne unsurlarına dayanan; asıl, küllî, umûm, âdet ve kat'î kavramlarıyla yakın ilişkisi bulunan; cüz'î delillerin anlamsal birlikteliği esası üzere işleyen ve şer'î alanda kat'î küllî neticeler üretebilen bir istidlâl yöntemi olduğu sonucuna ulaşılmıştır. Manevî istikrâ yöntemi ve bu yöntemin ait olduğu usûl anlayışının modern zamanda naslara ve nasların konusu olan insan hayatına dair parçacı ve öznel yaklaşımların ortaya çıkardığı problemlerin giderilmesinde bir çözüm kaynağı olabileceği düşünülmektedir.

In this study, it is aimed to present the thematic induction method (al-istiqrā al-ma'nevī) adopted by Shāṭıbī in an integrity by considering its historical background and establishing its connection with the understanding of method (uṣūl al-fiqh). Within the scope of this study, which consists of four sections apart from the introduction and conclusion, the intellectual foundations of thematic induction and some of its manifestations in the history of fiqh, the main reasons leading Shāṭıbī to adopt this method, the nature of thematic induction, the basic concepts related to it, and universal principles (qavā'id) and purposes (maqāṣıd) proved and grounded by the thematic induction method were examined. In this study, based on al-Muvāfaqāt, content analysis and comparison method were followed. The study concludes that the method of al-istiqrā al-ma'nevī bases originally upon a nonverbal transmission, induction and presumption; that it has a close connection with the concepts of origin (aṣl), universal (kullī), general ('umūm), custom ('ādet) and definitive (qat'ī); that it operates on the basis of thematic unity of juridical evidences; and that it produces plenary conclusions within the area of Islamic law. It is thought that the thematic induction method and the procedural understanding to which this method belongs can be a source of solution in solving the problems caused by fragmentary and subjective approaches regarding the authoritative texts (naṣṣ) and the human life which is the subject of the authoritative texts in modern times.
